WARRANTY

Stitch N’ Genius, Inc., DBA Rolling Styler ("Company") extends this limited warranty to the original retail purchaser ("Consumer") of the EZcurler®.
LIMITED One (1) Year WARRANTY:
The EZcurler® and its parts are warranted against manufacturer defects for one (1) year from the date of purchase. This limited warranty only covers the items specifically listed above for the period specified. IF THE WARRANTY REGISTRATION CARD IS NOT COMPLETED AND RETURNED TO COMPANY AT THE TIME OF THE ORIGINAL SALE, CONSUMER MUST PROVIDE PROOF OF PURCHASE WITH ANY WARRANTY CLAIM.
1. EXCLUSIONS:
Excluded from this limited warranty are damages to the EZcurler® caused by unreasonable or unintended use, abuse or neglect. Also excluded is damage from ordinary wear and tear.
2. VOIDING OF LIMITED WARRANTY:
THE FOLLOWING OCCURENCES OR CONDITIONS WILL VOID THIS LIMITED WARRANTY: (1) USE FOR COMMERCIAL PURPOSES; (2) FAILURE TO USE THE EZCURLER® ACCORDING TO COMPANY'S SPECIFICATIONS AND INSTRUCTIONS INCLUDING, WITHOUT LIMITATION, SAFETY INSTRUCTIONS AND WARNINGS; (3) FAILURE TO PROPERLY CLEAN AND MAINTAIN THE EZCURLER® AS STATED IN THE MANUAL; AND (4) TRANSFER OR ASSIGNMENT OF THIS WARRANTY.
3. SOLE REMEDY:
The sole remedy under this limited warranty is repair or replacement, at Company's option, of the EZcurler® or part(s) deemed to be defective. "Repair" or "Replacement" shall mean providing the labor and materials necessary, at no cost to the consumer, to repair or replace defective part(s) or replace, at Company's option, the EZcurler®.
4. HOW TO MAKE A WARRANTY CLAIM:
To present a claim under this limited warranty, email to warranty@ezcurler.com to receive a return authorization, and then send the product with the return authorization to the address instructed on the reply to your email.
5. DISCLAIMER:
THE WARRANTY IN THIS DOCUMENT IS THE ONLY WARRANTY ON THE EZCURLER®. COMPANY MAKES NO OTHER WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WHICH EXCEED THE OBLIGATION OR TIME LIMITS STATED IN THIS WARRANTY ARE HEREBY DISCLAIMED BY COMPANY AND EXCLUDED FROM THIS WARRANTY. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

CONSUMER AND COMPANY EXPRESSLY AGREE THAT REPAIR OR REPLACEMENT OF THE EZCURLER® OR THE DEFECTIVE PART(S) IS THE EXCLUSIVE AND SOLE REMEDY OF CONSUMER. COMPANY MAKES NO OTHER REPRESENTATION OR WARRANTY OF ANY KIND, AND NO REPRESENTATIVE, EMPLOYEE, OR DISTRIBUTOR OR DEALER OF COMPANY HAS THE AUTHORITY TO MAKE OR IMPLY ANY REPRESENTATION, PROMISE OR AGREEMENT WHICH IN ANY WAY VARIES THE TERMS OF THIS LIMITED WARRANTY.
6. NO CONSEQUENTIAL DAMAGES:
COMPANY ASSUMES NO LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING, WITHOUT LIMITATION, LOSS RELATED TO PROPERTY, LOSS OF USE, LOSS OF REVENUE, LOSS OF TIME, INCONVENIENCE, OR ANY OTHER ECONOMIC LOSS. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
7. LEGAL RIGHTS:
This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
8. INFORMAL DISPUTE RESOLUTION:
The parties to this limited warranty agree to submit to mediation to resolve any warranty disputes.
9. GOVERNING LAW:
The laws of the State of California will govern this limited warranty.

3-YEAR EXTENDED SERVICE CONTRACT
1. EXTENDED SERVICE CONTRACT:
Stitch N’ Genius, Inc., DBA Rolling Styler ("Company") offers this three (3) year extended service contract to the original retail purchaser ("Consumer") of the EZcurler® for an additional $19.99

The THREE (3) YEAR EXTENDED SERVICE CONTRACT covers the EZcurler® and its parts against manufacturer defects. Coverage under this extended service contract begins when the manufacturer's one (1) year Limited Warranty ends and continues for an additional three (3) years. COMPANY SHALL CONFIRM PROOF OF PURCHASE IN ORDER TO PROCESS ANY WARRANTY CLAIM.
2. EXCLUSIONS:
Excluded from this extended service contract are damages to the EZcurler® caused by unreasonable or unintended use, abuse or neglect. Also excluded is damage from ordinary wear and tear.

THE CONSUMER IS NOT ENTITLED TO A REFUND IF THE EXTENDED SERVICE CONTRACT IS CANCELED FOR ANY REASON.

NO REFUNDS OR CREDITS WILL BE ISSUED.
5. HOW TO MAKE A SERVICE CONTRACT CLAIM:
To present a claim under this extended service contract, YOU MUST EMAIL US AT CLAIMS@EZCURLER.COM  AND SEND US PROOF OF PAYMENT AND EXPLAIN US WHAT IS THE PROBLEM WITH YOUR EZCURLER®


Thereafter, the customer service representative will instruct the Consumer concerning where to send the defective product for repair or replacement. A PAYMENT FOR $19.95 IS REQUIRED TO PROCESS YOUR CLAIM. After Company has received the product from the Consumer and a check for $19.95, a new or repaired EZcurler® will be shipped to the Consumer to the return address specified on the Consumer's package.
6. INFORMAL DISPUTE RESOLUTION:
The parties to this extended service contract agree to submit all disputes to mediation.
7. GOVERNING LAW:
The laws of the State of California will govern this extended service contract.

Return Policy

Stitch N’ Genius, Inc. DBA Rolling Styler offers a return policy for products purchased directly from it. A purchaser may return to Stitch N’ Genius, Inc. DBA Rolling Styler within the applicable return policy period, products purchased directly from Stitch N’ Genius, Inc. DBA Rolling Styler for a credit or a refund of the purchase price actually paid (excluding trial offer payments), less shipping and handling fees previously charged to the purchaser. NO credit shall be given for shipping and handling fees previously charged, unless otherwise indicated. 

All products purchased directly from m Stitch N’ Genius, Inc. DBA Rolling Styler may be returned within thirty (30) days from the date on the bottom of the shipper label for a credit or a refund of the purchase price actually paid (excluding trial offer payments), less shipping and handling fees previously charged. In the case of products purchased on a trial basis directly from Stitch N’ Genius, Inc. DBA Rolling Styler which are returned on a timely basis in accordance with the terms hereof, no further payments shall be charged to the purchaser.

You must receive a Credit Return Authorization Number in order to return the products. Email returns@ezcurler.com to receive your Credit Return Authorization Number. 
You must ship the products within seven (5) days of the date you receive the Credit Return Authorization Number. You must:

• Return the products in the original packaging, in as-new condition along with any media, documentation, and all other items that were included in the original shipment to you.
• Ship the products at your expense, and insure the shipment or accept the risk of loss or damage during shipment.
• Mark the outside of your return shipping box with your Credit Return Authorization Number and your first and last name in clearly printed letters.
• Credit for partial returns may be less than the purchase price paid

NO credit shall be given and no return shall be accepted if a Credit Return Authorization Number is not requested within the return policy period. NO credit shall be given and no return shall be accepted if the products are not postmarked within seven (5) days of the date you receive the Credit Return Authorization Number. In addition, any returned products which are shipped and postmarked more than seven (5) days after the date on which you receive the Credit Return Authorization Number will be rejected and returned to you.
